[미국] 특허 출원을 서둘러야 하는 이유 및 빠른 출원 방법특허 출원을 서둘러야 하는 이유는 특허 분쟁시에 등록된 특허의 기준일은 특허 등록일이 아니라 특허 출원일이기 때문이다. 보다 상세한 이유를 살펴보면 다음과 같다.1. 특허 침해에서 어느 쪽도 증거를 제시하지 못한다면 출원일이 빠른 특허을 가진 쪽이 승리함.2. 특허 출원일이 늦어질수록 특허 심사과정에서 선행기술에 의해 거절되거나 특허소송에서 무효화될 확률이 높아짐3. 특허 출원이 늦어질수록 출원자 자신의 상업적 활동이나 반포된 간행물에 의해 법적으로 등록 거절될 수 있음4. 미국 특허 출원일 전에 미국에서 발명자가 출판한 간행물에 대해서는 1년의 유예기간(grace period)이 존재해 미국 특허 등록에 영향을 주지 않지만 외국 특허로 출원시에는 거절될 수도 있음최대한 빨리 특허 출원의 필요성이 있는 발명의 경우에는 하기와 같은 방법들을 이용할 필요가 있다.1. 발명자의 최초 공개 문서와 과학 논문 초고가 존재하는 경우에는 가출원(provisional application)을 활용해 해당 문서의 요약서와 단일 청구범위를 특허출원서를 출원하고 우선 출원일을 확보한 이후에 본 출원을 진행함2. 청구범위를 가능한 넓게 잡고 종속항의 초안을 잡는 것이 효율적임3. 빠른 출원일을 확보하는 것이 매우 중요한 발명인 경우에는 신규성 확인을 위한 선행기술 조사를 보류하거나 출원의 초안과 병행함4. 즉시 출원이 필요한 경우에는 도면의 완성을 기다리지 말고 발명의 대략적인 스케치를 활용함5. 빠른 출원일을 확보하는 것이 매우 중요한 발명인 경우에는 선언서나 양도증과 같은 정식 서류없이 출원하여 출원일을 획득한 이후에 보정서를 제출함
